TERMS AND CONDITIONS
RAWTREKK SAFRIS is a brand of PlugIN AFRICA Ltd, a
registered company in Kenya. The safaris and tours featured on this website are
operated by DREAM KENYA SAFARIS Ltd (‘the Company’ or ‘us’), the sole agent of
RAWTREKK SAFARIS. RAWTREKK SAFARIS is an intermediate for DREAM KENYA SAFARIS
Ltd. Please note that these terms and conditions, and the relevant details set out on this website, govern the
relationship between DREAM KENYA SAFARIS LTD and you under the
total exclusion of any other terms and conditions. No alternations to the terms
and conditions may be made by any party unauthorised by the Company.
1. ROLE OF THE COMPANY
The
role of the Company is to organise tours and safaris with set itineraries
and custom made tours and safaris to fit the requirements of our customers. In
doing so, we may use independent suppliers for the provision of selected
services. However we accept responsibility for the proper performance of your
contract with us subject to the following booking conditions.
2. PRIVACY
The Company guarantees to keep all personal information provided gathered in the
enquiry and/or booking process as strictly confidential and no personal
information will be made available to unconnected third parties, unless obliged
to do so by law or legal process.
3. BOOKING YOUR KENYA
SAFARI
Bookings should be
made as early as possible to guarantee availability of accommodation on your
desired safari departure date.
Please call, email or
fax us your initial requirements and we will reply promptly to confirm the
price and availability, in order for you to advise whether you wish to make a
booking. If so, we will go ahead and secure your reservation once a deposit has
been received.
When you make a booking and pay a deposit, or pay in
full (if you are booking within 35 days of departure), a confirmation
invoice will be sent to you by email or post as confirmation of the services
booked. A contract will exist as soon as the Company issues you with a confirmation invoice. It is your
responsibility to check this confirmation invoice, and to advise the
Company within seven days of receipt of confirmation invoice if there are any
errors or omissions.
If you arrange your holiday direct
with the Company all correspondence will be forwarded to the lead passenger on
the confirmation invoice unless otherwise stipulated. If your booking is made
through a travel agent all communications by the Company will be made to that
address.
The Company will try and arrange
for special requests submitted together with the booking request to be met but
these cannot be guaranteed. The Company will not be liable if any special request
is not met.
4. PAYMENTS
Please note that your accommodation
etc. will be requested for confirmation once your deposit, or full payment, has
been received. Your confirmation invoice will indicate the total and remaining
cost of your requested package after deduction of your deposit and which parts,
if any, of your itinerary are still on request and unconfirmed at the time the
invoice being issued.
Deposits
A deposit of 20% of the total price
of the safari or tour per person is payable upon making a booking. Upon receipt
of the deposit the Company will forward a confirmation invoice.
Full payments
Payment of the balance is due no
later than 35 days before departure. If the booking is made within 35 days of
departure, full payment is required at the time of booking.
Overseas payments
If you book
from Overseas please transfer deposit and final payment to either our European
or Kenyan bank account. Details will be included with the initial
invoice.
Alternatively,
you can pay with your credit card (Visa, MasterCard) over the telephone or via
fax. Please note that credit card bookings incur a 4% credit card fee.
Local payments
Should you
have booked your Kenya safari while
on holiday here you can either pay per credit card or in cash before your set
departure date.
Currency
Payments are billed
in Kenya Shillings KSH, or the equivalent in € Euros or US$ using the current exchange rate applicable on the date
when your cash payment is made or your card is charged.
The payment of the
deposit or any other partial or full payment for a safari or tour reservation
constitutes agreement and consent to all provisions of the terms and conditions
as stated here and contained in the brochure or customised itineraries.
If payment is not received on the
due date the safari or tour arrangements will be liable to cancellation which
will lead to loss of deposit (see section 5).
5. CHANGES MADE TO A CONFIRMED
BOOKING BY YOU
Where changes are possible an
administration fee of US $ 25 or Euro € 20 or the equivalent in Kenya
Shillings, per alteration, and additional costs due to the nature of the change,
if any, are applicable. Please note: Most accommodation and flight bookings
cannot be changed without payment of cancellation charges and/or the cost of
replacement accommodation due to demand, especially in high season.
6. CANCELLATION BY YOU
The
Company’s cancellation charges are determined by the fact that once your
accommodation and transportation (i.e. local airlines) has been booked, the
Company will be charged a cancellation fee when cancelling a booking.
Any
cancellation by the client must be advised in writing to the Company by the
lead passenger. Cancellation will only come into effect on the day written
advice is received by the Company. Recorded or Special Delivery is strongly
recommended. When sending your cancellation via email the Company will acknowledge
its receipt within 48hrs of receipt. Without acknowledgement it must be assumed
that electronic communication was not received and hence no cancellation notice
was sent.
We
try to keep cancellation charges to a minimum for clients, however, upon receipt of your
cancellation the following charges will be payable by you, depending upon the
number of days prior to departure your cancellation notification has
been received. This means, for example, that if you are travelling on the 25th
of July and the cancellation of your safari or tour is received on the 1st of
July, cancellation period will be calculated as 24 days prior to departure.
There is no refund
for any unused portions of the tour program once tour has commenced.
Cancellation penalties on airfare are additional and will depend on the
applicable airfare.

7. CANCELLATION OR ALTERATION BY THE COMPANY
The Company reserves the right to
cancel your holiday at any time. In the event of the Company having to alter,
amend or cancel the safari, providing due fees have been paid by you, you will
be offered a choice of an alternative safari of comparable standard if
available and if this is not acceptable, a full refund of all monies received
by the Company will be due.
After refunding all
partial and full payments, the Company has no other obligations to passengers
of cancelled trips.
Circumstances amounting to
"force majeure" include any event which the Company or the supplier
of the services in question could not, even with all due care, foresee or avoid
such as war or threat of war, civil strife, riot, terrorist activity,
industrial dispute, natural or nuclear disaster, fire, floods, sickness, bad
weather, the acts of any Government or public authority and all similar events
which are beyond our control. It is regretted that under such circumstances
there will be no compensation payable and that neither the
Company nor its agents shall be or become liable or responsible for any loss,
injury of damage of person, property or otherwise in connection with and
accommodations, transportation, or other services rendered to the client.
8. PRICE POLICY
Prices on
this website, if any stated, and in any other communication or advertising
method of the Company, were calculated on the basis of known costs at the time
of writing. The price of unsold safaris may be increased or decreased at any
time owing to currency, tax, levy and seasonal fluctuations. The price of your
safari will be confirmed on booking. When you have booked your safari and paid
your deposit or the full amount if you book within 35 days of departure, the
price of your holiday as shown on your confirmation invoice is guaranteed and
will not be subject to any changes or surcharges unless you elect to change the
confirmed booking (see section 4). At no time is the Company liable to give a
breakdown of costs due to the nature of the safari bought by the client.
Any credit card payments
are billed in US$. Please note that credit card
bookings incur a 4% credit card fee. Cash payments can be made in
Sterling Pound £, European Euros €, American Dollars US$ or Kenyan Shilling KSH
using
the current exchange rate applicable on the date when the card is charged or your
cash payment is made.
Due to
the financial commitments being made by the Company we regret we are not able
to make reductions in safari prices should any currency strengthen, as well as
no further payment will be required by you should any currency weaken.

that all pricing and itineraries are subject to final confirmation.

9. RESPONSIBILITIES OF THE COMPANY
The
Company, its affiliates and related persons act as agents for accommodation
providers such as lodges, hotels and camps; transport companies including, but
not limited to, airlines, bus companies and railroads; providers of meals,
tours, sightseeing and other pertinent services.
Bookings are accepted
on the specific condition that the Company acts only as agents of the passenger
in all matters relating to accommodation, sightseeing tours, restaurants, all
forms of transportation and other services which may be included in these
tours. The Company purchases these services from suppliers and other independent
contractors, without warranties and representations from them and thus such
services are not subject to its control.
10. RESPONSIBILITY OF THE CLIENT
You are responsible to
arrive at stated departure times and places and any loss or damage or
additional costs which you suffer through failure to do so lies with you. The
Company has no liability whatsoever to you through your failure to do so.
Parts of the safari
involve travelling in high altitudes and driving over dirt, rough, and dusty
roads. Any physical disability that may require special attention or treatment
must be reported in writing at the time of making a reservation. Passage may be
refused to anyone whose state of health or physical conditions render them, in
the opinion of the Company or its suppliers, unfit.
You
shall comply with instructions of any representative of the Company, safari
guide or local ground operator at all times. No client shall be accepted or be
permitted to continue on a safari while their status or mental or physical condition
is, in the opinion of any representative of the Company, safari guide or local
ground operator, such as to render them incapable of caring for themselves or
other safari clients and the company will not be responsible for expenses by
such persons precluded from completing the safari for this reason.
11. RISKS
The company draws
your attention to the fact that travel carries some measure of inherent risk
including, but not limited to, the hazards of travelling in underdeveloped
areas where road conditions and other facilities may be poor or lacking; the
forces of nature; and accident or illness in remote regions without means of
rapid evacuation.
Although the Company
will try to advise and help you whenever possible, it is your sole
responsibility to seek appropriate medical advice prior to departure as to
whether or not you are fit enough to undertake and complete the safari booked.
The
Company shall not be liable for any illness, injury or death sustained on
safari sold by us, which is not due to the gross negligence of the Company, its
officers, employees, authorised representatives or agents whomsoever.
As soon as you have
been issued a confirmation invoice and payment for your trip is received by us
you acknowledge this warning and agree to release and hold harmless the Company
from any damages that may result as listed above.
12. COMPLAINTS
Most problems can be rectified
straight away if the Company is aware of them. If you have a complaint you must
report it immediately and directly to the supplier (e.g. Lodge Manager), or the
emergency contact numbers provided by us. If you fail to follow this procedure,
this may affect your rights under this contract, as we have been deprived of
the opportunity to investigate and rectify the problem. If the problem cannot
be resolved locally and you wish to complain, full details must be received in
writing within 28 days of return from safari or excursion, otherwise the
Company
has the right to disregard any disputes brought to its attention.
13. INSURANCE
We believe it is essential to take
out travel insurance when you go on holiday to give you peace of mind. Please
make sure that you take out comprehensive cover. Please advise us of the policy
details by telephone or in writing when making your booking. Please note that
the Company is not liable to assist you financially should you decide not to
take out cover and the need for it arises at any point before, during or after
the safari or tour.
14. CARRIAGE BY LAND, SEA AND AIR
Carriage by land, sea
and air is subject to the terms and conditions of the carrier with whom you
travel and to international conventions, some of which may limit liability.
Land, sea and air travel are also subject to operational decisions of carriers
and sea ports which may result in cancellations, delays or diversions. This
means that airlines and airfares stated on this website, any brochures,
itineraries or advertising of the Company are subject to change without notice.
The Company has no control over these events and cannot accept liability whatsoever.
The Company cannot be
held responsible for any additional costs incurred by the passenger due to
cancelled or delayed flights. These costs will be borne by the tour member.
All baggage is
carried at the passenger's own risk, and the Company reserves the right to
exclude certain baggage at its discretion. Although
the Company will strive to help you track and retrieve any temporarily lost
baggage, if necessary, it does not accept responsibility for temporary or
permanent loss of baggage, which is the responsibility of you or the carrier,
not the Company.
The passenger
contract in use by the airline carriers concerned, when issued, shall
constitute the sole contract between the transportation companies and the
purchaser of these programs and / or the passengers. The limitations of
liability are contained on the reverse side of the airline ticket and form part
of the terms and conditions of this package.
15. TRAVEL DOCUMENTS
Final travel documents
and tickets will be handed to you at your safari or tour briefing before
departure on your safari or tour. If required, or requested by you, travel
documents will be mailed by overnight or registered mail two weeks prior to
departure date.
It is your
responsibility to ensure that passport, visas, travel permits, heath
certificates, inoculations, international driving license or other
documentation required for your safari or tour are obtained and are in order
and you are liable to meet any additional costs incurred by yourself or by the
Company on your behalf as a result of any failure by you to comply with such
requirements.
All vouchers,
contracts and tickets issued by the Company or its agents, are issued subject
to current tariffs, terms and conditions under which the services are provided
by such hotels, transport and tour companies and providers.
16. ACCOMMODATIONS
Accommodations
are based on double occupancy with private bath at hotels, lodges and camps. At
certain lodges, private baths may not be available. Single rooms are subject to
a supplemental charge. Triple accommodation, although generally not available
at lodges, may be requested. Child acceptance policies vary and will be advised
upon enquiry.
17. INCLUSIONS AND EXCLUSIONS
Expenses
and terms not mentioned on this website are not covered, including but not
limited to: passport, visa and immunisation charges; meals other than stated;
beverages served with meals; laundry, pressing/ironing or any other additional
service offered by your safari accommodation; items of a personal nature;
baggage handling and transportation to any hometown airports from gateways
listed and gratuities to van drivers/guides. Additionally, any optional activities at lodges and camps featured on this website are
subject to additional fees, which are payable directly at your accommodation,
just like mini-bar or laundry costs.
Rates do include
National Park or Reserve entry fees, internal flights if booked; all land
transportation arrangements originating and ending at your holiday
accommodation; full board accommodation unless otherwise stated on this
website, in a quote, itinerary or confirmation invoice and the services of your
driver-guide for the duration of your safari or tour.
18. PHOTOGRAPHY
The Company reserves the right to make
use of any photography or film taken on any safari, sold by the Company, by any
staff member, safari guide or operator for general purposes without payment or
permission.
19. CONSENT
The payment of the
deposit or any partial payment for reservation for a safari or tour constitutes
consent to all provisions of the terms and conditions contained on this
website, in any brochure (electronic or otherwise), invoice and travel
documents. The terms under which you agree to take these safaris or tours
cannot be changed or amended.
20. LIABILITY
While all precautions are taken to
ensure the passenger's property, safety and enjoyment on these tours, the
Company and/or its agents shall not be liable for death, injury, delay, loss or
damage arising from any cause in any
manner whatsoever or change of itinerary or, including any acts of terrorism,
acts of God and government, neglect, accident, error or omission caused by any
of these suppliers or independent contractors, their employees, representatives
or any event beyond the control of the Company.
While every effort is made to maintain
equipment in first class condition, the company cannot undertake to immediately
replace any item that might malfunction in the course of a safari.
21. NOTICE OF ENFORCABILITY
Please remember, when
you book travel related services with the Company, you are entering into a
binding agreement where all terms and conditions are fully understood as stated
in this document.
22. DISCLAIMER
The descriptions, information and opinions on this
website by the Company in respect of hotels, lodges, camps and other suppliers
whose services are used are given in good faith, based on the latest
information at the time of publishing.
Although the Company endeavours
to provide accurate, up to date and truthful information in any brochure or
advertisement of any form, and on this website, neither the Company nor
any of its employees, agents and associates make any representations or give
any warranties, whether expressly, tacitly or implied, as to the operation of
the website, the information, content, materials and products included and
available from this website.
The Company, its employees, agents and associates will
not be liable for any damage of whatsoever nature arising or resulting from the
use of or inability to use this site or the information contained hereon,
including but not limited to direct, indirect, incidental, punitive and
consequential damage.
The photographs
reproduced and information provided depict typical scenes experienced on safari
and details on each destination; but the subject matter may not necessarily be
seen or experienced while visiting that destination.
